Introducing GAMC Arbitration

The Global Arbitration & Mediation Council (GAMC) offers comprehensive, binding, and enforceable arbitration services for domestic and international disputes. Our expert panels, transparent processes, and adherence to global conventions make us the trusted choice for resolving complex commercial conflicts. All proceedings are aligned with the Arbitration and Conciliation Act, 1996 (India), UNCITRAL Model Law, and the New York Convention (1958), ensuring awards are enforceable worldwide.

Understanding Arbitration

Arbitration is a private, binding dispute resolution process where parties agree to submit disputes to one or more neutral arbitrators instead of a court. The arbitrator's decision—known as an award—is final and enforceable, offering certainty and closure.

Freedom to choose decision-makers
Customizable procedures
Complete confidentiality

These attributes make arbitration ideal for commercial matters where maintaining relationships and protecting sensitive information is essential. GAMC's arbitration framework aligns with UNCITRAL Model Law and global conventions, ensuring international credibility and enforceability.

Binding & Enforceable

Arbitration awards are final and legally binding, with limited grounds for challenge. They are enforceable worldwide under the New York Convention (1958) across 160+ countries.

Types of Arbitration

Comprehensive arbitration services tailored to different dispute categories

International Commercial Arbitration

GAMC provides binding resolutions for cross-border commercial disputes, offering a neutral and globally recognized forum. Proceedings strictly adhere to international standards, ensuring that awards are enforceable worldwide under the New York Convention (1958).

Typical Cases:

  • Multi-jurisdictional contracts involving parties from multiple countries
  • International trade and sale of goods under conventions such as the CISG
  • Joint ventures, shareholder conflicts, and cross-border business relationships

This type of arbitration safeguards parties against legal uncertainties stemming from differing national laws by allowing the selection of neutral arbitrators and applicable law, ensuring procedural fairness and confidentiality.

Domestic Commercial Arbitration

Designed for disputes arising within India, GAMC's domestic arbitration offers a streamlined, cost-effective, and fair resolution process aligned with the Arbitration and Conciliation Act, 1996. It is ideal for expediting resolutions while respecting natural justice principles.

Typical Cases:

  • Breach of contract claims in business agreements
  • Disputes among partners or shareholders of Indian companies
  • Conflicts related to supply chain, logistics, and service delivery within India

This arbitration type enables businesses to avoid prolonged court delays, maintaining commercial relationships through private and efficient adjudication.

Investment Arbitration

Specialized dispute resolution focused on conflicts between foreign investors and host states, governed by Bilateral Investment Treaties (BITs), Free Trade Agreements (FTAs), and other international instruments. GAMC's panel includes experts in public international law and investment treaties.

Typical Cases:

  • Expropriation, nationalization, or confiscation of investments
  • Violations of Fair and Equitable Treatment (FET) standards
  • Claims of denial of justice, discriminatory treatment, or breaches of treaty obligations

Investment arbitration is crucial in safeguarding international capital flows by providing an impartial and enforceable mechanism to resolve sovereign investment disputes.

Construction & Infrastructure Arbitration

Focused dispute resolution for complex construction and infrastructure projects, incorporating arbitrators with technical expertise in engineering, architecture, and project management to address nuanced claims with informed decisions.

Typical Cases:

  • Project delays, disruption claims, and extension of time disputes
  • Variation orders, changes in scope, and cost overruns
  • Defect liability, performance bonds, and warranty enforcement

This arbitration type ensures technical complexities are thoroughly understood, accelerating dispute resolution without compromising on quality or fairness.

Interstate Arbitration

GAMC also recognizes the significance of interstate arbitration, which facilitates dispute resolution between nation-states or governmental entities. Though less common, this arbitration plays a strategic role in settling sovereign disputes while avoiding escalation to conflict.

Typical Cases:

  • Boundary and territorial disputes between countries
  • Disputes over international treaties and diplomatic agreements
  • Claims relating to cross-border resource sharing (water, maritime zones, etc.)

Interstate arbitration is conducted under international public law principles and offers a diplomatic pathway for the peaceful resolution of international conflicts.

Maritime Arbitration

GAMC provides a specialised mechanism for resolving maritime and shipping disputes with neutrality, efficiency, and confidentiality. Proceedings align with international maritime practices and global frameworks such as the Hague-Visby and Hamburg Rules, with awards enforceable worldwide under the New York Convention (1958).

Typical Cases:

  • Charterparty disputes (voyage, time, bareboat)
  • Cargo damage, loss, or contamination under bills of lading
  • Shipbuilding, repair, and vessel financing agreements
  • Collisions, salvage, towage, and marine insurance claims
  • Offshore operations and port or terminal service disputes

This process ensures that industry-specific complexities are decided by experts, delivering fair, predictable, and commercially aligned outcomes.

Aviation Arbitration

GAMC offers a specialised platform for resolving aviation and aerospace-related disputes with neutrality, technical expertise, and confidentiality. Proceedings follow internationally accepted aviation and commercial standards, and awards remain globally enforceable under the New York Convention (1958).

Typical Cases:

  • Aircraft leasing, financing, and sale agreements
  • Maintenance, repair, overhaul (MRO) and service-level disputes
  • Air carriage claims involving passenger rights, cargo loss, or delay
  • Airline–airport contracts, ground handling, and logistics issues
  • Manufacturer, supplier, and component-related contractual disputes

Aviation Arbitration ensures that highly technical and safety-sensitive matters are adjudicated by experts familiar with aviation operations, delivering efficient and commercially sound resolutions.

GAMC Arbitration Framework

Composition of the Arbitral Tribunal

  • For claims below INR 1 crore: A sole arbitrator is appointed unless parties agree otherwise.
  • For claims exceeding INR 1 crore: A three-member tribunal is constituted unless parties agree to a sole arbitrator.
  • Each party nominates one arbitrator, and the GAMC Council appoints the Presiding Arbitrator where applicable. GAMC ensures each tribunal is impartial, competent, and aligned with the nature of the dispute.

Institutional Arbitration and Panel of Arbitrators

  • GAMC offers a vetted panel of arbitrators comprising distinguished professionals in law, commerce, engineering, finance, and more.
  • Every panelist is assessed for integrity, neutrality, and domain expertise, ensuring credibility and consistency in all proceedings.

Recommended GAMC Arbitration Clause

""Any dispute or difference whatsoever arising between the parties out of or relating to the construction, interpretation, operation, or effect of this contract, or the breach thereof, shall be settled by arbitration in accordance with the Rules of Arbitration of the Global Arbitration & Mediation Council (GAMC), and the award rendered thereunder shall be final and binding on the parties.""
